Hall County Court Records

Court recordings, case files, dockets, calendars, exhibits, and other documents produced by courts during a criminal or civil process form Hall County court records. The court rules adopted by the various courts in Hall County influence the creation, retention, and public disclosure of court records. Hall County court records are officially managed by the Hall County Clerk of Court and county courthouses for the purposes of accountability, transparency, reference, and research. Are Hall County Court Records Public?

Yes. The Georgia Open Records Act, contained in O.C.G.A. § 50-18-70 et seq., grants public access to court records and allows interested persons to inspect and copy them. The Clerk of Court is the official custodian of court records in Hall County-requests for court records may be directed to this office. Note that although most court records and documents are open to the public, some of these records may be restricted by court order or judicial laws. Generally, case information like party names, case numbers, dockets, and calendars may be available for public inspection, while court records involving juveniles, sealed/confidential court records, and personally identifiable information contained in court records are typically restricted from public access.

What Information is Available in Hall County Court Records?

Hall County Court Records Search

Hall County court records are generally open to the public and may be obtained online, in-person or via mail and phone requests. The following options are available for public access to court records in Hall County:

Online Access

The online portals available for public access to Hall County court records are:

  • The Hall County Clerk of Court’s Online Case Docket-contains criminal and civil case files and information created by the Superior and State Courts. Civil case information from the Magistrate Court is also available via this online docket. Interested persons may review court records and case files for free on this portal by entering a case number, party name, CSE number, alias, citation number, or filing date.
  • The Georgia Magistrate Records Online Docket -an online repository for Magistrate Court civil cases only. Case information may be retrieved free of charge by inputting a name, file type, case number, and other search criteria
  • The Georgia Probate Records Online Docket -provides access to statewide probate records, court hearings calendar and Hall County estate filings from 2010 till date.

In-person Access

The Clerk of Court’s office and the other county courts allow in-person visits within regular hours. Persons interested in reviewing and obtaining court records in Hall County may visit the clerk’s office or the county courthouse on weekdays between 8am and 5pm. Inspection of court records is usually free at the courthouse or clerk’s office but requesting copies may attract nominal fees dependent on the record type and volume.

Mail and Phone Requests

Mail requests containing adequate descriptions, search information, and appropriate search fee payments may be sent to the clerk of court’s office in a self-addressed and stamped envelope. Payment methods for mail requests usually include checks or money orders. The Hall County Clerk of Court’s office does not necessarily provide court records and case information over the phone. However, inquiries about record request procedures may be processed over the phone.

Fees for Court Records in Hall County

The fees for court records in Hall County vary by record type, format, size, certification, and court. Typically, the fee schedule for Hall County Superior Court records is as follows:

  • Uncertified copies cost $.50 per page if assistance is not required and $1 per page if assistance is required.
  • First pages of certified or exemplified records cost $2.50 while subsequent pages are provided at $.50 each.
  • Oversized documents and those larger than 8½" x 14" cost $2 per page.
  • The preliminary page of computer printouts, faxed or electronic records, is provided at $2.50 each, while additional pages cost $1 each.
  • Sealing and Certification of records cost an additional $2 per copy.

The Magistrate Court, on the other hand, provides regular copies of its records at $.25 per page while certified copies are provided at $3 per page.

  • Hall County Superior Court -the court of general jurisdiction that hears civil cases such as divorce, equity, habeas corpus, adoption, custody, mandamus etc. The superior Court also has exclusive jurisdiction over felonies and handles certain misdemeanors and appeals.
  • Hall County State Court -trial court of limited jurisdiction that handles criminal misdemeanors and non-equity civil cases.
  • Hall County Juvenile Court-hears cases of truancy, dependency, termination of parental rights, traffic offenses, rehabilitation and status offenses involving persons below 18 years.
  • The Magistrate Court -has both civil and criminal divisions. The civil division handles small claims not more than $15,000, garnishments landlord-tenants filings and personal property foreclosures. The criminal division oversees applications for warrants, county ordinance violations, first appearance hearings and fraud cases involving deposit accounts.
  • The Probate Court-issues marriage and weapon carry licenses, handles administration of a decedent’s estate, and oversees conservatorship/guardianship for minors or incapacitated adults.

Criminal Records Access in Hall County

State-level criminal history checks for Hall County are typically managed by the Crime Information Center (a division under the Georgia Bureau of Investigation) and not the county courts. The Records Division of the Hall County Sheriff’s Office and other local police departments also process criminal history record checks for interested persons at $20 per search. Concerned persons may be required to provide a valid government-issued ID card and details about the record such as the subject’s name, birth date or social security number. One may also retrieve criminal records in Hall County by querying the clerk of court’s office in person or utilizing the online case dockets provided by the clerk’s office.

Hall County Probate Records

Hall County probate records include case files and records created from litigations involving administration of intestate estates, probate of wills, marriage/weapon carry licenses, guardianships/conservatorships, commitments to involuntary evaluation and treatments for alcohol abuse, mental health, and drug dependency.

The Hall County probate court handles all probate cases and recently began to accept electronic and online filing of probate for ease and convenience. While probate records are generally open to the public under the public records act, certain probate records may be exempt from public access and sealed by law-wills and probate filings, estate records, and records of guardianships/conservatorships may not be publicly available. Most probate and estate records, especially those created from 2010 till present, may be accessed online via the online docket provided by the Probate Court.

Hall County Family Court Records

The Hall County Superior Court maintains records of family law cases such as divorce, adoption, custody, child or spousal support and domestic issues. Most family court records are available for public inspection via the clerk of court’s online case docket or in-person searches at the clerk’s office. Note that sensitive information and confidential records may be redacted from public records.

Certified copies of family court records may be obtained from the clerk’s office at $2 per copy plus the copy fees per page. Alternatively, interested persons may request or look up certified copies of family court records on the GSCCCA eCertification Portal. Users may be required to register an account and login for access to desired records.

Federal Court Records in Hall County

The United States District Court for the Northern District of Georgia has federal jurisdiction over Hall County. The District Court resolves cases of bankruptcy, constitutional/civil rights, and federal crimes. The District courthouse serving Hall County is located at Sidney O.
